Will the SCV Protect Its Trademark?

You may recall that famed Virginia Flaggers photographer Judy Smith, who has a problem spelling “heroes,” also has a problem honoring other people’s trademarks and copyrights, even as she demands that people respect hers. Such remains the case with these faux license plate magnets she produced. The SCV directed her to change the original template so that the magnet would not mimic the now-gone Virginia SCV plate, including a reproduction of the SCV’s logo (which was done without permission).

So you would think that the Virginia Flaggers would honor the SCV’s request, and that Judy would exchange the flawed magnets for the current product? You would be wrong. Lookie here at what someone found along “the Boulevard” today:

VF plate pix one

VF plate pix two

VF plate pix three Oh my. Guess that some people don’t care what the SCV says, which may be one reason the Virginia Division singled out the Flaggers for criticism last June.

Pass the popcorn, y’all.

Quote “Guess that some people don’t care what the SCV says, which may be one reason the Virginia Division singled out the Flaggers for criticism last June.”

LoL, not hardly. How can that be, when the Va Division hardly ever says anything?

Besides, they didn’t single out the VaFlaggers.

“… does hereby condemn the actions of ALL OTHER organizations purporting to represent Southern History and the Confederate Soldier, including, but not limited to, the Virginia Flaggers and the Army of Northern Virginia Mechanized Cavalry…” (All-caps emphasis added.)

All other organizations would also include the UDC and the OCR even though they’re not specifically named. (That’s why it says, “including, but not limited to….”)

So you are now arguing that the Virginia Division of the SCV was also condemning the UDC? Right.

All other organizations purporting to represent Southern History and the Confederate Soldier which serve to damage the reputation of the Sons of Confederate Veterans and the Confederate Veterans.

Resolved that on this 14th day of June 2015, the Executive Council of the Virginia Division, Sons of Confederate Veterans does hereby condemn the actions of all other organizations purporting to represent Southern History and the Confederate Soldier, including, but not limited to, the Virginia Flaggers and the Army of Northern Virginia Mechanized Cavalry, which, although they may be well intentioned, nevertheless serve to damage the reputation of the Sons of Confederate Veterans and, indeed, the Confederate Veterans themselves. We, therefore, call on the members of those organizations, especially those who are also members of the SCV, to search their hearts, humble themselves, and cease and desist from all false, negative, petty, rude, damaging, and dishonorable public activities and pronouncements.

Specified: the Virginia Flaggers and the Army of Northern Virginia Mechanized Cavalry.

It is important for Chastain to lie. She knows no other way. It’s a sign of desperation.

Those two groups were singled out specifically because they are two of the biggest troublemakers in Virginia. It does not seem that the National SCV and the VA Division play well together. While the VA Division denounced these groups, the National has remained silent and chooses to stay out of things. Haven’t heard a peep about the magnets. The National SCV won’t write me back.

Isn’t the VA division that biker gang?

          • Brooks D. Simpson September 27, 2015 / 12:50 pm

No. But that’s who the Virginia Division is also highlighting. Chastain would like you to forget that. Her ranting about it is a fine example of what passes for logic among certain Confederate heritage apologists.

I do know that Virginia SCV biker gang is a nasty bunch with a lot of LOSer crossover. And Ms. Judy “Copyright”Smith is very involved with them too.

Well, maybe her perspective was so slanted she couldn’t read the rest.🙂

          • Brooks D. Simpson September 27, 2015 / 12:53 pm

Chastain’s efforts to explain this away are amusing. They serve to draw more attention to the error.
